SUMMARY OF AMICUS BRIEF FILED 9/19/2016


In Sept. 2016, TIDA submitted an amicus brief supporting JB Hunt’s Petition to Transfer to the Indiana Supreme Court, to overturn a $19. 2 mil. net verdict against JB Hunt.

The brief focused on an erroneous independent negligence theory against motor carrier JB Hunt and erroneous duty on JB Hunt to monitor, 24/7, weather and road conditions for all of its drivers nationwide and then to make the call for them to cease operations if the conditions so dictate.  The TIDA member filing the brief was Mike Langford of Scopelitis, Garvin, Light, Hanson & Feary in Indianapolis, Indiana.  Unfortunately, the Indiana Supreme Court denied the motor carrier’s appeal.
